These Terms of Service ("Terms") govern your access to and use of the Subacademy platform, operated by Subcheck (collectively, "Subacademy," "we," "us," or "our"). By creating an account or using the platform, you agree to be bound by these Terms. If you do not agree, do not use the platform.
"Platform" refers to the Subacademy website at subacademy.org, the application at app.subacademy.org, and all related services, content, and features.
"Content" refers to all educational materials, text, graphics, videos, assessments, software, and other materials made available through the Platform.
"User" or "you" refers to any individual who accesses or uses the Platform, whether or not they have created an account.
"Organizational Account" refers to an account created by or on behalf of an organization for the purpose of managing multiple user accounts.
You must be at least 18 years old to create an account and use the Platform. By creating an account, you represent and warrant that you meet this age requirement.
You agree to provide accurate, current, and complete information during registration and to keep your account information updated. Providing false or misleading information may result in account suspension or termination.
Each individual may maintain only one personal account. Creating multiple accounts to circumvent assessment limitations, artificially inflate completion records, or for any other deceptive purpose is prohibited.
Subacademy provides a free, structured e-learning platform for harm reduction training. The Platform includes educational modules, video content, interactive lessons, knowledge assessments, and certification upon successful completion.
Access to all modules, assessments, and certifications is provided at no cost to individual users. We reserve the right to introduce optional premium features or organizational management tools in the future, but core educational content will remain free.
We strive to maintain Platform availability but do not guarantee uninterrupted access. The Platform may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will provide reasonable advance notice of planned downtime when possible.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at support@subacademy.org if you suspect unauthorized access to your account.
Accounts are personal and non-transferable. Sharing account credentials with others, allowing others to complete assessments on your behalf, or any form of credential misrepresentation is prohibited and may result in revocation of certificates and account termination.

All Content on the Platform — including but not limited to course materials, text, graphics, logos, icons, images, video, audio, software, and the compilation and arrangement thereof — is the exclusive property of Subacademy, Subcheck, or our content licensors, and is protected by international copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform and its Content solely for your personal, non-commercial educational purposes. This license does not include the right to modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any Content.
"Subacademy," "Subcheck," and associated logos and marks are trademarks of Subcheck. You may not use these marks without our prior written consent, except as reasonably necessary to refer to our services (e.g., stating that you completed Subacademy training).
If you believe any Content on the Platform infringes your copyright, please contact legal@subacademy.org with a detailed description of the alleged infringement, identification of the copyrighted work, and your contact information.
Certificates are issued upon successful completion of module assessments at or above the required pass threshold. Each certificate includes a unique verification URL that allows third parties to confirm its authenticity.
Subacademy certificates represent completion of structured educational training. They do not constitute professional licensure, clinical certification, or any form of legally mandated credential. Certificates do not replace any certification, license, or qualification required by federal, state, or local law, regulation, or employer policy in any jurisdiction.
We reserve the right to revoke certificates if we determine that the holder obtained them through fraudulent means, including but not limited to: having another person complete assessments on their behalf, using unauthorized assistance during assessments, or providing false identity information.
Certificate verification is available to any party with whom you share the verification URL. Verification discloses only the certificate holder's name, module title, completion date, and validity status.
Any feedback, suggestions, ideas, or other information you provide to us regarding the Platform or its Content ("Feedback") becomes our property. You hereby assign to us all rights in any Feedback and agree that we may use it without restriction or compensation to you.
We are under no obligation to use, acknowledge, or compensate you for any Feedback, and we may implement similar ideas independently.
If you create or manage an organizational account, you represent that you have the authority to bind your organization to these Terms. You are responsible for the activities of all users enrolled through your organizational account.
Organizational administrators can view enrolled users' module progress, assessment scores, and certificate status. Administrators cannot access individual assessment responses. See our Privacy Policy for details on data handling in organizational contexts.
Individual users enrolled through an organizational account retain all rights described in these Terms and our Privacy Policy, including the right to delete their personal account and data.
All Content on the Platform is provided for educational and informational purposes only. Content does not constitute medical advice, clinical supervision, legal counsel, or professional recommendations. You should always follow your organization's established protocols and consult qualified professionals before making clinical or legal decisions.
THE PLATFORM AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
While we strive to ensure that all educational content is accurate, current, and evidence-based, the field of harm reduction is rapidly evolving. Drug supply patterns, legal frameworks, clinical best practices, and regulatory requirements change frequently and vary by jurisdiction. We cannot guarantee that content reflects the most current conditions in your specific location or context.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SUBACADEMY, SUBCHECK, AND THEIR OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO:
IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY EXCEED ONE HUNDRED U.S. DOLLARS (USD $100). Some jurisdictions do not allow limitations on implied warranties or liability for incidental or consequential damages, so the above limitations may not apply to you in full.
You agree to indemnify, defend, and hold harmless Subacademy, Subcheck, and their officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.
You may terminate your account at any time through your account settings or by contacting hello@subacademy.org. Termination does not affect certificates already issued, which remain verifiable subject to Section 7.3.
We may suspend or terminate your account immediately, without prior notice, if we reasonably believe that you have violated these Terms, engaged in fraudulent activity, or if continued provision of services to you poses a risk to the Platform or other users. We may also terminate accounts that have been inactive for more than 24 months.
Upon termination, your right to access the Platform ceases immediately. Sections 6 (Intellectual Property), 7.2–7.3 (Certificate limitations and revocation), 10 (Disclaimers), 11 (Limitation of Liability), 12 (Indemnification), and 14 (Governing Law) survive termination.
These Terms are governed by and construed in accordance with the laws of the United States. Any U.S.-specific matters shall be governed by the laws of the State of Delaware.
Any dispute arising from or relating to these Terms or the Platform shall first be attempted to be resolved through informal negotiation. If the dispute cannot be resolved within 30 days, it shall be submitted to binding arbitration under the rules of the American Arbitration Association. The language of arbitration shall be English.
To the extent permitted by applicable law, you agree to resolve disputes with us on an individual basis and waive the right to participate in any class action, collective action, or representative proceeding.
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Subacademy regarding your use of the Platform and supersede all prior agreements.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, pandemic, internet disruptions, or infrastructure failures.
We reserve the right to modify these Terms at any time. When we make material changes, we will:
Your continued use of the Platform after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree, you should stop using the Platform and delete your account.
